1. Operator information and scope of application

Welcome to bralgei.com (the “Site”). These Terms and Conditions of Use (the “Terms”) govern the contractual relationship between:

• ZPM Coaching SRL, a Romanian legal entity registered in the Trade Register, with registered office at Intrarea Morarilor 1–3, Saftica, Ilfov 077015, Romania, email: [email protected], phone: +40 726 678 526 (the “Operator”, “we”, “Bralgei”)
• and the user — any natural or legal person who accesses and/or uses the Site (“you” or the “user”)

These Terms apply to all visitors and users of the site, including those who access content, purchase products or services, or interact with any feature of the Site.

Use of the Site is conditional upon full acceptance of these Terms. Accessing the Site constitutes your express consent. If you act on behalf of a legal entity, you declare that you have the legal authority to bind that entity.

2. Informational nature — not medical advice

The products, information, services and any other content published on and through this Site — including information relating to health, nutrition, food supplements, biohacking, training and longevity — are provided for informational purposes only and do not replace professional medical advice.

Do not use the information available on the Site to diagnose or treat medical conditions, to prescribe or modify drug treatments, or to replace medical consultation. Every organism is unique, and individual reactions to products or protocols may vary significantly.

Consulting a specialist doctor is mandatory before starting any diet, physical exercise programme, supplementation or other health regimen, particularly if you suffer from chronic conditions, are undergoing drug treatments, are pregnant or breastfeeding.

Food supplements marketed under the Thot Nutrition brand are legal food products, not medicines. Health claims mentioned on the Site have not been evaluated by the National Sanitary Veterinary and Food Safety Authority (ANSVSA) or the European Food Safety Authority (EFSA) for the purpose of diagnosing or treating diseases.

3. Conditions of access and use of the site

By using the Site, you undertake to:

• Be at least 18 years of age or, if you are a minor, to have obtained the consent of a parent or legal guardian
• Not use the Site for illegal purposes or in any way that could harm the rights, interests or security of other users or the Operator
• Not attempt to gain unauthorised access to the Site’s systems, networks or data
• Not transmit defamatory, obscene, threatening, spam or intellectual property-infringing content
• Not use robots, spiders or other automated tools to access the Site without our prior consent
• Provide accurate and up-to-date information when completing forms or creating an account

We reserve the right to restrict or suspend your access to the Site, without prior notice, in the event of a breach of these conditions.

4. Services and purchases

4.1 Types of products and services

Through the Site you may purchase:

• Thot Nutrition physical products — food supplements delivered to the specified address
• Coaching and training programmes — services provided online or in person, including Master Training Level 1, 2, 3
• Digital courses and products — educational materials in digital format, delivered via online access immediately after payment confirmation

4.2 Payment processing

Online payments are processed exclusively through third-party payment processors (Stripe via WooCommerce), which use standard SSL encryption. Your banking data is not stored on our servers and is not accessible to us. The Operator issues fiscal documents (tax invoice) for all transactions, in accordance with Romanian tax legislation.

4.3 Prices and availability

Prices displayed on the Site include VAT where applicable. We reserve the right to modify prices and product availability without prior notice. The applicable price is that displayed at the time of completing the order.

5. Consumer right of withdrawal

As a consumer, you benefit from the rights provided by Government Emergency Ordinance No. 34/2014 on consumer rights in contracts concluded with professionals and Law No. 449/2003 on the sale of products and associated guarantees.

• Physical products: You have the right of withdrawal within 14 calendar days of receiving the product, without needing to provide reasons. Returned products must be in their original condition, unopened and unused. The cost of return is at your expense, unless the product is defective or incorrectly delivered.
• Digital courses and products: By purchasing and accessing a digital product, you expressly agree to the immediate provision of digital content and waive your right of withdrawal, in accordance with Art. 16(m) of GEO 34/2014. If you have not accessed the digital content, you may request a refund within 14 days.
• Coaching and training services: If the service commences within the 14-day withdrawal period, at your request, you expressly agree to immediate provision and waive your right of withdrawal pro-rata for services already provided.

6. Intellectual property and copyright

All content on the Site — graphic design, texts, articles, images, videos, sounds, logos, trademarks, software, databases and other materials (collectively, the “Materials”) — is the exclusive property of ZPM Coaching SRL / Bralgei or its licensors and is protected by Law No. 8/1996 on copyright and related rights, Law No. 84/1998 on trademarks and geographical indications, and applicable international legislation.

We grant you a limited, non-exclusive, non-sublicensable and revocable licence to access and view the Materials solely for personal, non-commercial purposes. This licence does not include the right to:

• Reproduce, copy, distribute, sell, rent or sublicense the Materials
• Modify, adapt or create derivative works based on the Materials
• Use the Materials for any commercial or public purpose without our prior written consent
• Remove or alter any copyright notices or other proprietary notices
• Reproduce or imitate the design, structure or content of the Site

The trademarks and brand names “Bralgei”, “Thot Nutrition”, “ZPM” and “Under2ms” are the exclusive property of ZPM Coaching SRL. Any unauthorised use constitutes infringement and gives rise to civil and/or criminal liability.

7. Links to third party sites

The Site may contain links (hyperlinks) to third party websites, including scientific reference sites, third-party e-commerce platforms or social networks. These links are provided solely for your convenience and do not constitute an endorsement or recommendation of the respective content, products or services.

Bralgei does not control and is not responsible for the content, privacy policies, practices or availability of third party sites. Access to these sites is at your own risk and is subject to their own terms and conditions.

The presence of a link on our site does not imply any commercial or legal association with that site.

8. Disclaimer and limitation of liability

The Site and Materials are provided “as is” and “as available”, without warranties of any kind, express or implied, to the extent permitted by applicable law.

Bralgei does not warrant, in particular, that:

• The Site will be continuously available, timely or error-free
• Results obtained through the use of the Site will be accurate, complete or reliable
• Technical defects will be corrected immediately
• The Site or the servers hosting it are free from viruses or other harmful components

To the extent permitted by applicable Romanian and European legislation, including Law 449/2003 and Government Ordinance 21/1992, Bralgei’s total liability to you shall not exceed the amount paid by you for the product or service that gave rise to the claim, regardless of the nature of the claim (contractual, tortious or otherwise).

Bralgei is not liable for indirect, incidental, special, punitive or consequential damages (including loss of profit, loss of data, reputational harm) arising from the use or inability to use the Site.

9. Indemnification

You agree to indemnify, defend and hold harmless ZPM Coaching SRL, its directors, employees and representatives from any claims, actions, losses, expenses or damages (including reasonable legal fees) arising from:

• Your use of the Site in breach of these Terms
• Infringement of any third party’s rights through your actions on the Site
• Content you post or transmit through the Site
• Provision of false or inaccurate information

10. Termination of access

We reserve the right to suspend or terminate your access to the Site, in whole or in part, with or without prior notice, in the following situations:

• Breach of any provision of these Terms
• Fraudulent, abusive or illegal behaviour
• Requests from competent authorities
• Technical or security reasons

Termination does not affect rights and obligations accrued prior to it, including payment obligations assumed.

11. Governing law and dispute resolution

These Terms are governed by and construed in accordance with Romanian law, including the Civil Code, the Consumer Code (Law 296/2004), Government Ordinance 21/1992 on consumer protection, Government Emergency Ordinance 34/2014 on consumer rights and applicable European regulations, including GDPR.

In the event of a dispute, the parties will attempt to resolve it amicably within 30 days of notification. Failing an agreement, disputes will be submitted to the competent Romanian courts at the Operator’s registered office, except where applicable law establishes different territorial jurisdiction (for example, for consumers, jurisdiction may lie with the courts at the consumer’s domicile).

As an EU consumer, you also have the right to resort to Alternative Dispute Resolution (ADR) through:

• The National Authority for Consumer Protection (ANPC): www.anpc.gov.ro

12. Changes to these terms

We reserve the right to amend these Terms at any time. Changes take effect upon publication on the Site. We will notify you of material changes through a notice on the site and/or by email (if you have provided your address), at least 30 days before the changes take effect.

Continued use of the Site after the changes take effect constitutes acceptance of the new Terms. If you do not agree with the changes, please cease using the Site.
